TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale (“Terms of Sale”) govern the purchase, by users, of gift vouchers through the website https://figlideifiorirestaurants.com/ (“Website”) for access to the restaurants operated by Sunflower S.r.l., headquartered at Via Manzoni 18, 22100 Como, Tax Code 03676530136 (“Sunflower”).
The Website allows its users (“Customers”) to purchase a voucher as a gift to be used for lunch or dinner at one of Sunflower’s restaurants, chosen by the Customer from those available at the time of purchase (“Voucher”).
The value of the Voucher, expressed in euros, is indicated in the dedicated window on the Website (“Window”) and is valid for two people. The value displayed in the Window may vary; Sunflower reserves the right to modify it at any time without prior notice. The applicable value will be the one shown in the Window at the time the order form is submitted; any prior offers or subsequent price changes will not be considered.
The Voucher entitles the holder to order food and/or beverages up to the value of the Voucher. No change will be given if the total value is not used. The Voucher cannot be combined with other ongoing offers or promotions.
The Voucher is valid for 12 months from its date of issue (the date on which the Customer receives the PDF file containing the Voucher) and may be used for a single meal, subject to mandatory booking through one of Sunflower’s designated reservation channels.
Once the Voucher purchase procedure is completed, as described in paragraph 2 below, the Customer will receive a PDF file containing the Voucher. It is the Customer’s responsibility to send this PDF to the person they wish to give the Voucher to. The Voucher is non-transferable and issued in the name of the recipient. Sunflower shall not be held liable for any loss, unauthorized duplication or forgery of the Voucher.
To redeem the Voucher, a prior reservation must be made at one of Sunflower’s restaurants (among those available at the time of purchase), and the user must inform the staff at the time of booking that they will be using a Voucher. Reservations are subject to restaurant availability for the requested date and/or time; if unavailable, the Voucher can be used for another reservation, provided it is within the Voucher’s validity period.
To purchase a Voucher, the Customer must visit the Website and access the relevant Window, where they can add a Voucher to their shopping cart.
To complete the purchase, the Customer must access the cart and select the quantity of Vouchers they wish to buy. The system will display the total price, calculated based on the unit value published at the time of completing the purchase.
Clicking the payment button will open a new window where the Customer must enter their contact information, billing details, and (optionally) a message for the Voucher recipient.
The system will then display the full order and billing summary. The Customer must choose a payment method—either bank transfer or payment via Stripe—by ticking the appropriate box.
Then, the Customer must click the “Place Order” button. If the bank transfer option is selected, the system will provide bank details for completing the payment.
An automatic email will be sent to the address provided by the Customer, summarizing the order and, where applicable, including bank transfer details.
The Customer is responsible for completing the bank transfer after finalizing the order.
If the Customer chooses Stripe, they must follow the steps required by the online payment system. In all cases, a confirmation email summarizing the order will be sent.
After the order is submitted, Sunflower will verify the information and confirm full payment before sending the Voucher as a PDF to the email address provided during the purchase.
The Voucher purchase is considered complete when the Customer receives the PDF Voucher via email from Sunflower.
If the Customer is a consumer—i.e., a natural person acting outside of a business, commercial, artisanal, or professional context—they have the right to withdraw from the order without justification and at no cost.
To do so, within fourteen (14) days from the receipt of the PDF Voucher, the Customer must send an email to Sunflower (to the same address from which the Voucher was received) clearly stating their decision to exercise the right of withdrawal, including their personal details (name, surname, address) and the order number shown on the Voucher (“Withdrawal Notice”).
The right of withdrawal may be exercised only if the Voucher has not yet been used at any of Sunflower’s restaurants at the time the Withdrawal Notice is received.
Only the Customer may exercise the right of withdrawal—not the Voucher recipient. If the Customer withdraws, the recipient will no longer be able to use the Voucher.
Sunflower will refund the Voucher amount as soon as possible and no later than 14 days from receipt of the Withdrawal Notice. The refund will be made via bank transfer to the account details provided by the Customer.
Sunflower is not liable for any issues unrelated to the purchase or booking process (e.g., changes to the menu, unexpected restaurant closures, reservation blocks, etc.).
Sunflower reserves the right to modify these Terms of Sale at any time. Any changes will take effect once published online and will apply only to purchases made thereafter.
Customer data is processed by Sunflower S.r.l. in compliance with the applicable data protection legislation, as described in the privacy notice provided under Article 13 of EU Regulation No. 679/2016, available on the Website.
Any complaints must be sent to Sunflower S.r.l. via registered letter with return receipt or certified email (PEC) to sunflowersrl01@legalmail.it.
These Terms of Sale are governed by Italian law. For any disputes relating to the Voucher purchase, if the Customer is a consumer, jurisdiction lies with the court of the Customer’s place of residence or domicile within Italy. In all other cases, the Court of Milan has exclusive jurisdiction.
